1. Introduction & Operational Structure

This website and its associated services (the "Service") are a collaborative operation.

Content Owner: Lumos Global Limited ("Owner") owns the intellectual property, curates the experiences, and manages the community.
Platform Operator: PLAYNECT Limited ("Operator") provides the technical infrastructure, web hosting, and payment processing services on behalf of the Owner.

Throughout these Terms, "we", "us", and "our" refer collectively to Lumos Global Limited and PLAYNECT Limited, unless specified otherwise. By accessing the Service, you agree to be bound by these Terms.

2. Service Description

The Service offers:

Digital Content: Premium access to cultural stories, interviews, photography, and culinary guides (Curated by Owner).
In-Person Experiences: Hosted travel, cultural, and culinary events (Hosted/Organized by Owner).

3. Subscriptions & Payment Processing

Merchant of Record: Payments for subscriptions and experiences are processed by PLAYNECT Limited (via Stripe). Your bank statement may explicitly reference "PLAYNECT" or "Snout and Seek by PLAYNECT Limited."
Authorization: You authorize the Operator to charge your payment method on behalf of the Owner.
Billing Disputes: Any billing inquiries should be directed to our support team first. Initiating a chargeback because you do not recognize the Operator's name on your statement constitutes a breach of these Terms.

4. Digital Content Subscription

License: Granted by Owner.
Cancellation: Managed via the Platform.

5. In-Person Experiences (Liability Split)

Host Responsibility: All In-Person Experiences are organized and hosted solely by Lumos Global Limited. You acknowledge that PLAYNECT Limited acts purely as a booking platform and payment processor.
Agency Disclaimer: PLAYNECT Limited bears no liability for the safety, logistics, quality, or delivery of any In-Person Experience. Any claims regarding the experience itself (e.g., injury, cancellation, food quality) must be directed solely to the Owner.
Participant Waiver: Participation requires signing a separate waiver releasing the Owner from physical liability.

6. Intellectual Property

Ownership: All stories, photography, and brand assets are the exclusive property of Lumos Global Limited.
Platform Code: All underlying code, website architecture, and design templates are the property of PLAYNECT Limited or its licensors (Ghost).

7. Third-Party Tools & Infrastructure

The Service runs on infrastructure provided by the Operator and third-party tools (Ghost, Stripe, Calendly, Content Square). We provide the Service "as is" and neither the Owner nor the Operator guarantees 100% uptime.

8. Limitation of Liability (Dual Shield)

To the maximum extent permitted by law:

The Operator (PLAYNECT Limited) shall not be liable for any damages arising from the Content or In-Person Experiences (including personal injury, travel delays, or errors in travel advice).
The Owner (Lumos Global Limited) shall not be liable for technical failures, data breaches, or payment processing errors caused by third-party providers.
Aggregate Liability: Our collective total liability to you for any claims is limited to the amount you paid to access the Service in the past 12 months.

9. Indemnification

You agree to indemnify, defend, and hold harmless both Lumos Global Limited and PLAYNECT Limited (and their respective directors, officers, and employees) from any claim or demand arising out of:

Your breach of these Terms.
Your violation of any law.
Your conduct during an In-Person Experience.

10. Governing Law

These Terms are governed by the laws of Malta.
